After being stopped… You should respectfully comply with the officer’s request, provided they do not violate your rights. If the police do not have probable cause to stop you or search your person or vehicle, you should not give police permission to search. Do not say anything incriminating. Ask why you are being stopped. If they ask to search, you should say no. You should then ask if you are being arrested or detained. If they say no, then ask to leave.

During the arrest… Do not make statements to police or anyone else present. Nothing you say to police will prevent an arrest. If the police have probable cause for an arrest, you will be arrested. The best thing you can do is comply with the officer’s request and keep your mouth shut. Anything you do or say will be used against you in court.

While being searched… Before you are placed in the police car, you will be searched by officers. The purpose of the search is to ensure the officer’s safety. If the officer finds anything suspicious or illegal, you should not attempt to explain it away. Keep quiet. Focus on remaining calm and physically compliant during the search.

Going to jail… At every stage of the arrest, you will come into contact with officers that will ask you questions or attempt to get you to make an incriminating statement. Do not be fooled by the attitude or friendliness of the officer. Just as the officer said when they read you your Miranda rights, “anything you do or say can and will be used against you in a court of law”.
